N4N Judgement: Sahara Reporter files court notice of discontinuance

 

The Publisher of online medium, Sahara Reporters, Omoyele Sowore had through his counsel, Femi Falana (SAN) withdrawn the motion for appeal of N4billion fine against him for libel on the Senate President, Dr Bukola Saraki.

The medium was awarded the fine by Justice Sikiru Oyinloye of the Kwara State High Court for several libellous stories published against the Saraki between September and December, 2015.

The motion of discontinuance was however signed by Falana.

The motion reads; “that the defendants/applicants hereby wholly discontinue the motion notice dated 11th August, 2017 and filed same day.”

A source close to Saraki’s lawyer, Barr Tunde Olomu told this medium, last night that Sahara Reporters’ counsel had submitted a copy of the motion at Olomu’s office located at Offa Road, GRA, Ilorin.

He stressed that Sowore’s lawyer should have acted on the court judgement 6 days after it was delivered adding that they never handled the issue with the utmost seriousness it needed.

He however noted that Falana was seeking for an extension of time in the motion he filed which was the exact step they should have taken, adding that the extension of time will enable them to prepare and come up with better approach to the development.

“We have received copy of the filed motion in our office. Whether they’ve filed same in court, that I cannot say but I think they just want to start doing the right thing. I don’t know who advised them now. The step they wanted to take in the first place will land them in big shame as they cannot just ask the court to set aside the judgement.

“They had 6 days after the judgement was delivered to act but they did not, they are now coming for appeal, what are they appealing for,?” he queried.
