3 sentence to 9-yr imprisonment in Ilorin

Kwara State High Court judge, Justice Mariam Folayan has on Monday delivered a judgement sentencing: Rasheed Ikudayisi, Rasaq Ojuekun and Bayo Ikudayisi to seven (7) years imprisonment with an option of fine.

They were arraigned for attempting to murder one Muritala Ishaq along Oko-Olowo/Eyenkorin highway in Ilorin on 2nd May, 2016.

The court noted that the convicts waylaid Ishaq on his way thereby shooting him on the head at a close range.

They were however charged to court 2-count charge of conspiring to commit an illegal act wit; attempt to murder one Muritala Ishaq by shooting him on the head and thereby committed an offence punishable under section 97 of the Penal Code.

They were also charged for shooting the victim under which if the act had resulted into death of this victim, they would have been guilty of Culpable Homicide punishable with death and that they however committed an offence punishable under section 229 (1) of the Penal Code.

During the trial, three exhibits, namely: five pellets, one Honda Accord car with reg. no. AFN 341 MG and photographs of the victim – were tendered before the court.

The charge sheet further revealed that 7 persons including one Alhaji AbdulRaheem Jimoh of Old Eid Road, Ilorin, Insp. Adisa Bidemi of ‘G’ Division Oloje and Insp. Gbadebo Adeyemi of State Criminal Intelligence Department testified against the accused in court.

In the testimony according to one of the witnesses, Jimoh, the charge sheet quoted him thus, “I was in my house when a young man later known as Muritala Ishaq was rushed to my house by some men which I don’t know in the pool of his blood, that he was shot somewhere, I asked if they had reported the matter at the police station, they answered in affirmative. I started treating him, when the situation was getting out of hand, I called on my doctor…” he revealed.

However, after listening to lawyers from both sides; the state prosecutor, Barr. Jimoh Adebimpe Abdulmumini and Barr. Buhari Onis, the court ruled that, for criminal conspiracy, they were sentenced to two years imprisonment each with an option of N80,000 fine and for the attempted Culpable Homicide, they were sentenced to seven years imprisonment each with an option of N200,000 each.
