Threat: Court dismisses suit seeking prosecution of KASMAG boss

The magistrate court, sitting in Ilorin, Kwara State, on Tuesday, dismissed suit seeking prosecution of the Executive Director of KASMAG (transportation enterprise), Alhaji AbdulGaniyu Ibrahim Omoola.
The suit was instituted by Alhaja Aminat Bukola Folorunsho of Ile Alfa Adeta, Ilorin, through her lawyer Barr. Bola Rasaq Gold. It was struck out for lack of diligent prosecution.
Magistrate Bio Saliu, in his ruling over the matter on Tuesday, said the case was mentioned before him on 9th August, 2018 and it was adjourned to 15th of the same month.
According to the magistrate, the suit was adjourned in view of the fact that the defendant was not in court as the prosecution was unable to serve processes issued by the court.
“He eventually appeared before the court on 18th September, 2018 and the case was on the said date adjourned to 29th October, for hearing. Since then, the prosecution has failed to commence the hearing of the case till date and the subsequent adjournments were granted at its instance.
“To make the matter worse, the complainant in this case has never appeared, the conclusion to arrive at, in view of the foregoing, is that the prosecutor or the complainant doesn’t appear to be interested in the case against the defendant,” the magistrate said.
The court further granted application of the learned defendant’s counsel for the termination of the complaint against the defendant. He said, “he is accordingly discharged.”
Recall that the defendant was accused of unduely demanding for interest over the money he lent Alhaja Folorunsho which she used to boost her business.
By the term of payment the charge sheet noted that the complainant completed the payment of the money sometimes in early August, 2017.
“To her dismay, when she visited the accused, KASMAG boss, in his Unity office, Ilorin, to thank him on the money, the accused demanded an interest over the money and threatened that if she did not pay the interest, he would deal with our client,” the charge sheet stressed.
In carrying out the threat, the accused was said to have ordered his staff to seize the Toyota Camry saloon with registration number KEY 435 DS belonging to the complainant.
The seized car was said to be containing in the safe, necklace valued at N750,000, Nigerian International Passport and NYSC certificate among others.
