3 docked for allegedly belonging to gang of thieves

 

Three persons were on Tuesday docked by an Ilorin Magistrate Court for allegedly belonging to gang of thieves.
The three defendants; Sunday Sanni, Issac Daniel and one Elegbede were arraigned before  Magistrate Ibrahim Dasuki.
They were charged for criminal conspiracy and belonging to gang of thieves contrary to section 97 and 306 of penal code law.
The police First Information Report (FIR)  revealed that the case was transferred on 23/08/2019 from Divisional Police Station, Erin-Ile, Kwara State to State Criminal Intelligence and Investigation Department (SCIID), Ilorin for further investigation.
The report further revealed that on same date, one Sgt. Oyedele Gabriel alongside 3 others officers  on vehicular patrol raided a black spot in Idi-Ape compound, Igosun where Sanni, Daniel and Elegbede were arrested. It further revealed that Elegbede who claimed to be the owner of the hot drinks joint was operating illegally without licence.
The FIR further stated that the defendants are miscreants terrorising Igosun and its environ.
The prosecutor, Folorunsho Zacheaus said, in view of the denial of the content of the FIR, police investigation is ongoing. He prayed the court for another date.
On the issue of bail, the prosecutor submitted that the offence of belonging to gang of thieves is not ordinarily bailable. He also said that the defendants according to FIR have no fixed address and therefore may jump  bail if granted. He prayed the court to remand the defendants in prison custody.
On his part,  counsel to the defendants, Abdullahi Suleiman prayed the court to discountenance the prayer of the prosecutor. He prayed the court to grant the defendants bail on condition. He said though the offence of belonging to a gang of thieves is not ordinarily bailable, the FIR does not reflect the allegation charged against the defendants. He further said that the defendants will not jump bail if granted as they have reasonable sureties within the jurisdiction of the court.
He however prayed the court to grant the defendants bail.
In his ruling, Magistrate Dasuki granted the defendants bail in the sum of N50,000 each and two ordinary sureties each.
