6 granted bail over alleged public disturbance

 

The Magistrate court sitting in Ilorin the Kwara State capital has granted bail to  one Abdulrahman Omotosho,Aliu Mojeed, Yunusa Yusuf, Mustapha Ibrahim, Ayinde and Akolade Mumimi over unlawful assembly and disturbance of public peace.
The police First Information Report (FIR) revealed that the case was transferred from Divisional Police Headquarters ‘D’ Division Adewole to the State Criminal Intelligence and Investigation Department (CIID) for discreet investigation.
It revealed that based on the death of one Wasiu Issa who was killed by some unknown persons suspected to be cultists. On the spot search carried out by the police led to the arrest of Omotosho, Mojeed, Yusuf, Ibrahim, Ayinde, Mumuni at Alheri Hotel, Aleniboro area,  Ilorin. while smoking dangerous substances suspected to be indian hemp.
They were dragged before Magistrate Miriam Dasuki for criminal conspiracy, unlawful assembly, making atmosphere  noxious to health and disturbance of public peace contrary to section 97, 102, 192 and 113 of Penal Code Law.
In appearance for the defendants, Abdullahi Jimba appeared for Omotosho and Mumuni , Samuel Umoh appeared for Mojeed, A. R.  Shehu for Yusuf and Ayinde and Tunde Gegele for Mumuni.
However, the first three counsels consented that the most senior counsel  should take the lead.
The prosecutor, Isaac Yakubu said based on the denial of the defendants to the FIR,  he prayed the court to give another date.
In his submission, Gegele prayed the court to grant  the defendants bail as bail is at the discretion of the court and the offences are ordinarily bailable .He further said that the defendants are first offenders and have no record of any crime, that if granted bail, the defendants will not jump bail. nor tamper with police Investigation or commit same or similar offences.
In his ruling, Dasuki  admitted the defendants to bail in the sum of N100,000.00 each and 1surety each who must be within the jurisdiction of the court.
