Ile Arugbo: Court orders KWSG to halt demolition

The Kwara State High Court, sitting in Ilorin, on Monday, granted an ex-parte injunction restraining the State Government from further demolition of late Olusola Sarakiโs political social welfare home, popularly called, Ile-Arugbo.
The order was granted by Justice Abiodun Adebara following the motion exparte of the immediate past Senate President, Dr. Bokola Saraki, challenging the propriety of Governor Abdulrahman Abdulrazaq order on the demolition of his father’s property.
The court, in its ruling over the matter, restricted the state government from going near the land, โeither to construct or do anything on the land pending the determination of the Motion on Notice.โ
The court however fixed 15th January, to hear the motion on notice and substantive suit.
Meanwhile, in a writ of summons, Saraki has sued the Kwara State Government, House of Assembly, Attorney General, Director General of Bureau of Land and Inspector General of Police for illegal demolition of the property.
In the 17 pages writs of summons, which was filed before the court, the chairman of 8th Assembly sought six (6) declarations, two (2) orders and one (1) general damage.
Saraki sought a declaration that the resolution of the Kwara State House of Assembly passed and recommending/mandating the 1st Defendant to revoke the allocation of Plots 1, 3 and 5 TPS/MISC 129A situate at Illofa Road, G.R.A, Ilorin, Kwara State belonging to the Claimant is ultra-vires the powers of the Kwara State House of Assembly and in breach of the fundamental right to fair hearing of the Claimant guaranteed by the Constitution of the Federal Republic of Nigeria, 1999 (as amended).
He also sought a declaration that the recommendation of the 3rd Defendant declaring the allocation of the property of the Claimant as void without affording the Claimant to be heard amount to a breach of fair hearing and unconstitutional.
The former Kwara State governor however sought a general damage in the sum of N500million against the 1st, 3rd Defendants for illegal and wrongful revocation of the Claimants plots of lands.
