2 dragged to court over trespass on Emir’s land

A law firm, Ishola Sanni Consults based  in Ilorin on 28 May, 2019
filed a petition to the Commissioner of Police Kwara State Command on
behalf of His Royal Highness, Ibrahim Zulu Gambari, the Emir of Ilorin
against one Usman Abdulganiyu Arowolo of Araromi Village via Eyenkorin
and Mukaila Adeoti Pasa of Pasa Village via Eyenkorin over alleged
trespass to his landed property situated at Eyenkorin/Ballah road
opposite Crown Hill University Complex. The Police First Information
(FIR)  revealed .
The FIR further revealed that Arowolo and Pasa who claim ownership of
the land leased it to tipper drivers to use as refuse dump.
When challenged on the 21 May, 2019  by Vigilantes, Waheed Suleiman
and Yusuf Abdulkadir, who were assigned to keep watch over the
property, the duo chased them away with cutlass and deflated the tyres
of their motorcycles.
They were dragged before Magistrate Jibrin Salihu for Criminal
Conspiracy , Criminal Trespass and Criminal Intimidation contrary to
Sections 97,348 and 397 of Penal Code law.
The prosecutor, Adewumi Johnson said, investigation is ongoing on the
matter and therefore prayed th court to give another date.
Counsel to the defendants, Taofic Olateju said he has no objection to
the adjournment but however asked for the bail of the defendants. He
said the offences with which the defendants were charged with are
ordinarily bailable. Also that the defendants have been enjoying
police bail therefore will not jump bail if granted.
In his reaction, the prosecutor, Johnson said, bail is at the
discretion of the court. Citing section 397(B) of the penal code law,
Johnson added that the offence is not ordinarily bailable as the FIR
informed the court that the vigilante were chased away with a cutlass.
He however prayed the court to refuse the bail of the defendants as
their appearance before the court may not be ascertained if granted
bail.
In his ruling, Salihu granted the defendants bail to sum of
N300,000.00 each and 2 sureties each in 1 must be the head of the
family and the other must be residing within the jurisdiction of the
court, while the case has been adjourned to 16th July, 2019..
