When client languished in prison for 11 days despite granting of bail – Bar Saad Mohammed

Barrister Jimoh Saad Muhammad is an Ilorin based legal practitioner who graduated from the University of Ilorin in 2008 and attended the Abuja branch of the Nigerian law school. Called to the bar on 4th November, 2009 following the completion of his NYSC in Osun State, Mohammad joined the law chamber of Ilorin office of J.S Bamigboye (SAN) for his attachment in 2011 before he went ahead to establish his private office, J.S Mohammad & Associates in January 2020. In this telephone interview with ACTING EDITOR, MUMINI ABDULKAREEM, the Secretary-General of Ilorin NBA and one time chairman of the Kwara State branch of the Young Lawyers Forum (YLF) opens up on his most dramatic moment in practice thus far Excerpts:
One of the most dramatic moments for me in practice was when a particular client of mine was charged to court here in Ilorin and I applied for his bail which was granted. But my client was unable to perfect the conditions of the bail that was given by the court. It was only the third day that we could meet all the conditions. But still for some reasons, the bail was unable to be perfected after the second week and my client spent about eleven days or thereabout in prison. It was very dramatic to me that how could such a thing happened. Although, it was due to negligence on the part of the client or I would say his relatives because he was still in prison, to be unable to meet very simple condition that could have been met within three hours. The conditions were not stringent except for the deposit of one hundred thousand naira which the court gave. If the defendants relatives were up and doing, the conditions were easy to meet within a short time. So I was baffled that how could I apply for the bail of a client which was granted by the court and same person will go ahead to spend about 11 days in prison. In all my eleven years of practice, this will be the first time I will experience such. Apart from this, I use to have very successful and smooth handling of my cases. So to God be the glory.
